Discussions among all WTO members to facilitate the flow of services have been taking place for several years. TiSA has a limited number of WTO members, but together they account for about 70% of world trade in services. TiSA also offers the possibility of concluding an agreement to which other WTO members could join at a later date. WTO members have already signed a 1995 multilateral services agreement. They could include TiSA in current WTO rules and ultimately be part of WTO rules. The process was proposed to a group of countries that met in Geneva and were called very good friends. All negotiating meetings will take place in Geneva. The EU and the UNITED States are the main supporters of the agreement and are responsible for most of the common changes. Participating countries began drafting the proposed agreement in February 2012[5] and submitted their first bids at the end of 2013. [6] Reality: Under all existing free trade agreements, Canada will not make commitments for low-skilled workers within TISA. Will the TISA licensing procedures rules limit the ability of regulators to conduct environmental assessments before projects are approved? The TISA contains a general provision that creates a broad exception, among other things, for all measures necessary to protect human or animal or plant life or health. Therefore, in the unlikely event that an environmental assessment procedure does not comply with the TISA rules on regulatory procedures, it would remain exempt from challenge by another party.

It is important to recognize that TISA will not give foreign investors the opportunity to initiate disputes. Will TISA have an impact on Canada`s investment regime? As with all free trade agreements in Canada, including TISA, Canada reserves its ability to manage Investment Canada`s legislation. This allows the Canadian government to review foreign investment to ensure security and “net benefits” for our economy, while reflecting the current level of openness to investment in most service sectors. Additional political flexibility will be maintained. B for certain sensitive sectors (e.g. air and sea transport). Will TISA include an investor-state dispute settlement mechanism? TISA will not include an investor-state dispute settlement mechanism. Negotiations on a dispute settlement mechanism are based on the government`s approach to the World Trade Organization. Will TISA have an impact on public health care and public education? In all of its free trade agreements, Canada has never made commitments to public services such as health and public education.

How is TISA compatible with Canada`s progressive trade approach? The progressive approach to trade is a policy framework that recognizes that trade policies must be designed to meet the government`s overall economic, social and environmental priorities and to make a meaningful contribution. Canada`s approach to TISA is fully on the agenda, for example, because TISA will continue to guarantee the government`s right to regulation; it has the potential to support the development of different sectors of the environment, including renewable energy; supports innovation and inclusive economic growth, including specific benefits for small and medium-sized enterprises; and Canada is seeking a clear provision prohibiting countries from discriminating on the basis of their gender, as they relate to licences, authorizations and authorizations for service providers, as well as a provision for international cooperation to ensure access to information communication technologies for persons with disabilities. Can other countries participate in the TISA negotiations? The TISA negotiations are open to WTO members, as long as they show the capacity and willingness to be constructive and ambitious.
